GENERAL TERMS OF USE OF THE ONLINE SHOP AT WWW.WESTWING.SI
The following are our General Terms andConditions of Business(hereinafter referred to as "GTC"), which we use as the basis for the use of the Westwing online shop on the website www.westwing.si. By placing your order, you accept the following GTC of Westwing GmbH, Moosacher Str. 88, 80809 Munich, Germany (hereinafter referred to as "Westwing").
These GTC are applicable to consumers with a billing address in Slovenia who take advantage of the offers on our website. For the purpose of these GTC, consumers are any natural persons who obtain or use goods and services for the purposes outside their professional or gainful activity.
1. GENERAL AND SCOPE OF APPLICATION
1.1 Westwing operates an online shop on the website www.westwing.si.
1.2 To use the offers available in the Shop, persons must be over 18 years of age.
1.3 In principle, goods and services will only be sold in quantities that are customary for households.
1.4 These GTC apply to all contracts concluded via the website www.westwing.si, unless the B2B GTC for businesses apply.
1.5 If (working) days are specified as deadlines, these shall be understood to be all working days with the exception of Saturdays, Sundays and public holidays.
2. USE OF THE WWW.WESTWING.SI WEBSITE AND REGISTRATION
2.1 When placing an order, you will be asked to provide personal data which will be collected and processed in accordance with Westwing's privacy policy. Clause 18 applies.
2.2 You are responsible for the completeness and accuracy of the data. You are also obliged to keep your data up to date. If there is a change in the data provided during your use of the website, you must correct the information immediately. You are obliged to treat your passwords and any other access data confidentially and to protect them from access by unauthorised third parties.
2.3 You are solely responsible for the content (such as product reviews) that you post in the areas accessible for this purpose. You warrant that your own content does not infringe or violate the rights of third parties (e.g. personal rights or copyrights). In this respect, you fully indemnify Westwing against all claims of third parties upon first request. By submitting content to Westwing, you grant Westwing and all affiliated companies of Westwing in the Westwing Group (hereinafter referred to as the "Westwing Group") all simple, unlimited rights of use in terms of time, space and content, and also for the transfer to third parties, which Westwing requires for publishing and distributing the content, even only in part, on the websites of the Westwing Group.
2.4 In your customer account you can view and, if necessary, modify your open, recently shipped and/or completed orders, as well as manage and store your own data, vouchers, newsletters and notifications separately.
2.5 You may only register with one customer account in the online shop on the website www.westwing.si and you may only operate with one customer account at a time. If Westwing detects multiple registrations, Westwing may delete them.
2.6 It is prohibited to use the website www.westwing.si or its contents for illegal or abusive purposes or for purposes prohibited by these GTC. In particular, it is not permitted to disrupt or manipulate technical processes. In case of unjustified conduct or attempts to gain unjustified advantages to the detriment of Westwing or other customers, Westwing reserves the right to block the customer's account and not to accept orders.
2.7 Westwing reserves the right to exercise its virtual domiciliary rights at its own discretion and, for example, to issue warnings, refuse orders, restrict the available payment methods, suspend or terminate access to the website www.westwing.si or the membership or remove transmitted contents if the provisions of these GTC are violated or if an abuse of rights occurs. Your right of withdrawal in accordance with Clause 12 shall not be limited in any way by the aforementioned measures. Claims for damages by Westwing remain unaffected.
3. CONTRACTING PARTIES, LANGUAGE AND CONCLUSION OF THE CONTRACT
3.1 The contracting party when concluding contracts on the website www.westwing.si is Westwing.
3.2 The website www.westwing.si operates in Slovenian language. Contracts via the website shall be concluded exclusively in the Slovenian language.
3.3 After the selected products have been placed in the virtual shopping cart and the electronic ordering process has been completed, you submit a legally binding contractual offer by sending an order for the goods in the virtual shopping cart at that time by clicking the "Buy now" button. After submitting your offer, you will receive an e-mail from Westwing confirming receipt of your offer. This e-mail from Westwing does not constitute acceptance of the contract. It is at Westwing's discretion not to accept offers. If an order is not executed by Westwing, Westwing will inform you immediately. The contract is accepted by separate e-mail with confirmation of dispatch or confirmation of the provision of the service, but at the latest when the goods are dispatched.
3.4 Westwing stores the order data and sends it to you by e-mail after placing an order. This e-mail also contains the cancellation policy. You can also download the GTC at any time at https://www.westwing.si/i/terms_and_conditions/. If you have created a customer account before placing your order, you can always view the order data in the login area. This also applies to previous orders within the scope of statutory retention obligations.
3.5 The order processing and contact is normally carried out via automated order processing or by e-mail. You must ensure that the e-mail address you provide for order processing is correct, so that e-mails sent by Westwing can be received at this address. In particular, if you use SPAM filters, you must ensure that all e-mails sent by Westwing or third parties commissioned by Westwing to process your order can be delivered.
4. PRICES AND SHIPPING COSTS
4.1 For orders of goods and services on the website www.westwing.si, the prices indicated on the detail page of the relevant item at the time of ordering shall apply. The prices are total prices including VAT and packaging. Shipping costs and, where applicable, the costs of an assembly service that may be booked additionally (see Clause 5) shall be added.
4.2 The product prices of the Products in your virtual shopping cart will always match the current price on the product detail page. This means that the current product price may differ from the price at which you added the product to your virtual shopping cart. When you add a product to your virtual shopping cart, you don't reserve the price displayed at that time. The price of a product can go up or down between the time you add it to your virtual shopping cart and the time you actually buy it.
4.3 Shipping costs are charged separately for each order and are based on the price indicated on the product detail page. This depends, among other things, on the size, weight and the respective shipping method. The latter is at the discretion of Westwing.
5. PAYMENT TERMS
5.1 You can pay for the goods by one of the following payment methods: PayPal, credit card (VISA, Mastercard, American Express), Apple Pay and Google Pay (only available when ordering via the web browser).
5.2 Westwing accepts several credit cards, currently: VISA and Mastercard as well as American Express. Westwing will charge your credit card after receipt of your order via our payment service provider Stripe Payments Europe, Limited (registered with the Companies Registration Office Ireland under number 513174).
5.3 In case ApplePay or GooglePay (only for web browser orders) is selected as payment method, the payment will be processed by our payment service provider Stripe Payments Europe, Limited (registered with the Companies Registration Office Ireland under number 513174).
5.4 If a payment method offered by PayPal is selected, the payment will be processed through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., (registered in the Luxembourg Trade and Companies Register (RCS) under number B 118 349), subject to the PayPal User Agreement, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.
6. INVOICING
6.1 By accepting the GTC, you agree that Westwing may send you the invoice by electronic means or make it available to you by electronic means, in accordance with Article 232 of the Council Directive 2006/112/EC on the common system of value added tax and Article 84 of the Value Added Tax Act (Official Gazette of the RS, no. 13/11 with amendments).
6.2 Please note that if your data are not correct according to clause 2.2 when ordering, we are no longer able to issue a correction invoice in order to correct your data after your order is completed.
7. VOUCHERS
7.1 Westwing offers various types of vouchers: Gift Vouchers and Compensation Vouchers.
7.1.1 Gift vouchers
7.1.1.1 Gift vouchers are vouchers that can be purchased in the Shop and redeemed only at www.westwing.si, unless otherwise stated on the voucher. The gift voucher will be sent to you by e-mail after placing the order.
7.1.1.2 Gift vouchers and remaining balances of gift vouchers are redeemable until the end of the third year after the year of purchase of the gift vouchers.
7.1.1.3 Gift vouchers can only be used for the purchase of goods and services and not for the purchase of other gift vouchers.
7.1.1.4 If the price of your order is higher than the balance of a gift voucher, you can make up the difference using the payment methods offered. If the price of your order is less than the balance of a gift voucher, you can redeem the remaining balance with your next order.
7.1.1.5 In the event of cancellation of a contract, for whatever reason, the purchase price will be refunded by debiting the voucher account as well as the means of payment used in addition, if any.
7.1.1.6 The gift voucher is transferable.
7.1.1.7 Lost vouchers, especially stolen vouchers, will not be refunded. Westwing assumes no responsibility for the loss of voucher codes.
7.1.2 Compensation vouchers
7.1.2.1 Compensation vouchers are vouchers that cannot be purchased but are issued by Westwing at its discretion as compensation without recognition of any legal obligation.
7.1.2.2 The rules on promotional vouchers shall apply accordingly.
7.2 Westwing may, in case of justified suspicion of fraud or other activities contrary to law or conditions in connection with the purchase or redemption of a voucher, block the respective voucher code (also temporarily) or refuse the redemption (also temporarily). In the latter case, you are entitled to cancel the order.
7.3 Payment of the voucher amount is not possible, nor is a value transfer or subsequent offsetting for purchases already made, i.e. before the order process has been completed.
7.4 The aforementioned vouchers can only be redeemed by consumers.
8. DELIVERY AND SHIPPING CONDITIONS
8.1 Deliveries will only be made within Slovenia to the delivery address provided by you.
8.2 The basic delivery times are communicated to you on the detail page of the respective item.
8.3 The ordered goods will be shipped as a parcel or by freight forwarder at Westwing's discretion.
8.4 Westwing does not assume any procurement risk, in particular not in the case of a generic purchase. Westwing is only obliged to deliver from the stock of goods or from the deliveries of ordered goods from its suppliers. The delivery obligation of Westwing does not apply if Westwing is not supplied, not supplied in full or not supplied in time despite an existing hedging transaction with the respective supplier and is not responsible for this, Westwing has informed you of this without delay and a separate procurement risk has not been expressly agreed upon. Prepayments will be reimbursed by Westwing.
8.5 Westwing cannot be held liable for the non-performance or defective performance of Westwing's obligations under this contract if and insofar as this is due to the occurrence of force majeure, notwithstanding that Westwing will do everything in its power to minimise the consequences of such an event.
Force majeure shall mean any unforeseen event or events which, even if foreseeable, are beyond the control of Westwing and the effect of which on the performance of the contract could not have been avoided by reasonable efforts on the part of Westwing. This includes, but is not limited to, war, warlike conditions, revolt, rebellion, military or civil coup, insurrection, riot, mutiny, embargo, government order, fire, flood, storm surge, hurricane or other severe weather phenomenon on the scale of a catastrophe, earthquake, lightning strike, pandemic, epidemic, nuclear hazard or similar cause which is beyond the control of Westwing and which renders the performance or fulfilment of the obligations governed by these GTC illegal, impossible or commercially impracticable. If a case of force majeure occurs, Westwing is obliged to inform you immediately. Westwing is released from its performance obligation for the duration of the event. Delivery and performance deadlines are extended accordingly. If the force majeure lasts longer than eight (8) weeks, Westwing and you are entitled to withdraw from the contract.
8.6 If the delivery of the goods fails for reasons for which you are responsible, Westwing will charge you for the costs of a new delivery as well as reasonable storage costs from the day of the failed delivery. You will be charged for a new delivery even if the first delivery was free of charge for you. We will inform you of the additional costs before the redelivery and will only make the delivery with your consent. Please note that refusal of acceptance does not constitute an effective exercise of your right of withdrawal and must be expressly declared to Westwing. Westwing reserves the right to withdraw from the contract if you do not accept a new delivery within seven (7) days. In this case, Westwing will reimburse the payments already made by you. This also applies if you actually exercise your right of withdrawal. In this case, you will also be reimbursed the shipping costs (standard shipping).
9. WARRENTY, LIABILITY AND TRANSPORT DAMAGE
9.1 Unless otherwise stipulated in the following provisions, the provisions of the statutory liability for non-conformity (material defects) shall apply.
9.2 In the case of contracts for the delivery of used goods, the following restriction applies: The limitation period for claims for defects is one year from the delivery of the goods.
9.3 Notwithstanding mandatory statutory provisions, Westwing's liability is limited to cases of gross negligence or intentional misconduct on the part of Westwing.
9.4 The aforementioned limitations and exclusions of liability pursuant to No. 11.3 shall not apply to the extent that Westwing has fraudulently concealed the defect or has assumed a guarantee for the goods.
9.5 If the goods are delivered with obvious damage to the packaging or contents, we kindly ask you to immediately submit a complaint to the respective courier company and to contact Westwing's customer service (service@westwing.si). The notification has no effect on your warranty claims but makes it easier for Westwing to assert its rights against the courier company.
10. WARRENTIES
An additional commercial warranty is only available if it is explicitly stated and described on the product details page.
11. CONSUMER RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen (14) days from the day on which you or a third party appointed by you, other than the carrier, has taken possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter or an e-mail sent by post). You can use the following model withdrawal form, which is not mandatory:

In order to meet the withdrawal deadline, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

12. CONSEQUENCES OF WITHDRAWAL
If you have withdrawn from the purchase contract, we will reimburse to you all payments we have received from you, including the costs of delivery, without undue delay and at the latest within fourteen (14) days from the day on which we have received the notice of withdrawal from the contract. For reimbursement, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you. In no case will you be charged for this refund. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, depending on which condition is met first.
You must return the goods immediately and in any event within fourteen (14) days from the day on which you notify us of your withdrawal from the contract to the following address:

The deadline is met if you send the goods before the deadline of fourteen (14) days has expired. We shall bear the costs of returning the goods. You shall only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.
The right of withdrawal does not exist in the exceptions mentioned in Art. 135 of the Consumer Protection Act.
13. VOLUNTARY RIGHT OF RETURN FOR CONSUMERS
13.1 For all purchases of goods Westwing grants you a voluntary right of return for a total of thirty (30) days from receipt of the goods in addition to and independent of the statutory right of withdrawal according to Clause 11. This voluntary right of return granted to you by Westwing allows you to withdraw from the purchase contract even after expiry of the fourteen (14)-day withdrawal period (see Clause 11) by returning the goods to Westwing within thirty (30) days after receipt.
However, if you exercise this voluntary right of return after the expiry of the fourteen (14)-day period for exercising the statutory right of withdrawal from Clause 11, a prerequisite for exercising the voluntary right of return is that you return the goods complete, undamaged and in the original sales packaging. Otherwise, Westwing reserves the right to refuse the return. We point out that you bear the risk of transport when returning the goods within the framework of the voluntary right of return. The voluntary right of return does not apply to the purchase of gift vouchers.
13.2 The refund will be made to the means of payment used by you for payment. If direct debit has been selected as the means of payment, it is not necessary to object to it.
13.3 Your statutory right of withdrawal (see Clause 12) shall not be affected by the fulfilment of the requirements set out in this Clause 14 and shall continue to apply irrespective thereof. Until the expiry of the period of the statutory right of withdrawal, only the legal conditions listed therein shall apply. This contractually granted (voluntary) right of return does not limit your statutory warranty claims, which remain unlimited.
14. REIMBURSEMENT OF SHIPPING AND SERVICE COSTS IN CASE OF PARTIAL CANCELLATION
If you cancel the contract only for a part of the goods of an order (partial cancellation), Westwing will reimburse you the payments for the cancelled goods, including delivery and assembly costs (if not yet assembled). However, if (part of) the shipping and assembly costs would have been incurred even if you had ordered only the goods for which you did not cancel the contract, these are excluded from the refund.
15. RETENTION OF TITLE
The goods remain the property of Westwing until full payment has been made.

17. DISCLAIMER FOR HYPERLINKS
Insofar as www.westwing.si refers to websites of other providers via hyperlinks, Westwing has no influence on their content, does not adopt them as its own and assumes no guarantee or liability for their content. The respective provider or operator of the pages is always responsible for the content of the pages. As soon as Westwing becomes aware of legal infringements of websites of other providers, the corresponding hyperlinks on www.westwing.si will be removed immediately.

19. RIGHTS OF USE
The content of this website, including text, graphics, photos, illustrations, images, videos, sounds and software (hereinafter referred to as "Material") is protected by copyright. Downloading or use of Material for private use is permitted. Publication, transmission, reproduction or any other use of the content/Material is not permitted.
All rights of use of the Material on www.westwing.si belong to Westwing or our partners. The use of the Material, in any form, without the express written consent of Westwing is prohibited.
All trademarks used on the website may not be used without the prior written consent of Westwing.
20. ALTERNATIVE DISPUTE RESOLUTION

Westwing GmbH is neither willing nor obliged to participate in out-of-court consumer dispute resolution proceedings before an out-of-court consumer dispute resolution provider.
From 20.07.2025 the following applies:

21. CHANGES TO THE GTC
Westwing reserves the right to make changes to the website, rules, terms and conditions, including these GTC, at any time. Your order will be governed by the GTC in effect at the time you place your order, unless a change to these GTC is required by law or government regulation (in which case they will also apply to orders you have previously placed).
22. FINAL PROVISIONS
22.1 Any dispute arising out of or in connection with the use of www.westwing.si shall be governed exclusively by the laws of Slovenia, excluding its conflict of law provisions.
22.2 Should any provision be void or ineffective, the remaining provisions shall remain valid. In place of the invalid or ineffective provisions, the relevant statutory provisions shall apply.
